İMAM BİKİBRİS B. YALINKILIÇ ABDULLAH EN-NÂSİRÎ’NİN “EL-MUHTASARÜ’L-HÂVÎ Lİ’L-BEYÂNİ’Ş-ŞÂFΔ ADLI ESERİNİN TAHKİKİ

Abstract

İmam Bekibris b. Yalınkılıç Ebû Şucâ en-Nâsirî’nin “el-Muhtasarü’l-Hâvî li’l-Beyâni’ş-Şâfî” adlı bu kitabı, hacmli bir eser olmamasına ragmen Hanefî mezhebi içerisinde önemli kaynaklardan sayılmaktadır. Eser, klasik fıkıh kitaplarındaki karakteristik özelliklere sahip olup, esasen Hanefî mezhebindeki diğer fıkıh kitapları gibi kitap, bap, fasl gibi kısımlara ayrılmıştır. Eser Kitâbü’t-Tahâre ile başlayıp Kitâbü’l-Ferâiz ile son bulmuştur. Müellif eserini telif ederken Kerhî ile İsbicâbî gibi fakihler başta olmak üzere Tuhfetü’l-Fukahâ, el-Câmiü’s-Sagîr, el-Mebsût gibi seçkin metin, şerh, haşiye eserlerden kaynak göstermiştir. Bununla birlikte eserde birçok fetâva kitapları da kullanılmıştır. Ayrıca, Ebü’l-Hüseyin el-Kudûrî’nin muhtasarı esas alınmıştır. Önemli olmasına ragmen eser henüz basılmamış, tahkiki yapılmamış, akademik arenada hakkıyla tanıtılmamıştır. Bu çalışmamızın amacı eserin ve müellifin fıkıh ilmindeki yerini tespit etmek, her ikisinin de tanıtımını yapmak, yine eserin kendisinden önceki eserlere kıyasen yöntem açısından farkının ne olduğunu tespit etmek gibi konularla ilgili olacaktır. Metni tahkik esnasında günümüz akademik çalışmalarında esas alınan metodu kullanarak, müellifin Hicrî VI. asırda yaşadığı, genç yaşta ilim tehsil ettiği, dönemin alimleri arasında o dönemin “el-İmam” ilmî derecesine nail olduğu, Necmettin et-Turkî şeklinde lakaba sahip olduğu, birçok eserlerinin içinden “en-Nûrü’l-Lâmî‘ ve’l-Burhânü’s-Sâtî‘ fî Şerhi Akideti’t-tahâvî” adlı eserinin oldukça meşhur olduğu yönündeki bilgilere ulaştık.

ABSTRACT This book that named “al-Mukhtasar al-Havi li al-Bayan ash-shafi” writed by Imam Bikibris b. Yalınkılıch was called Abu Shuja an-Nasiri, it is so important book in the Khanafit School. And it was categorized according to classical chapters in the Khanafit Shcool. Tis book have to covers all issues thet begining from Kitab at-Tahara until to Kitab al-Faraiz. Imam Nasiri had to summarizing on this book from the different boks that writed in detail like Sharh al-Kharhi and Sharh al-Isbicabi, and al-Jami as-Sagir, and al-Mabsut. Also, Imam Nasiri used some fatava’s book and mukhtasar’s book like Mukhtasar al-Khuduri. Although to all these tridness this book is not issued and there is not verification work on this book. The purpose of this research it is present this book in the academical society. And the talking about Imam Nasiri, actually on his authority in the Islamic law. Also we’ll talk on the his methodology in the writing his this book. We followed in the writing this research the academic conditions that using today. Ofcourse, we guarded the text references to evidences of sharia and to ideas of fukahas. The results that achived by researcher they are; Imam Nasiri lived in the 6th century of Hijra, and he had to meeting with the Islamic studies in early years, and he achived to authority between the fukahas, so he was calling Najmuddin at-Turki, and he writed more boks. One of these boks was so popular it is “an-Nur al-Lami va al-Burhan as-Sati fi Sharhi Akidati at-Tahavi” that analized from the perspective of verification sciences.
