Abstract

الملخص الحمد لله حمداً كثيراً كما أمر والصلاة والسلام على خير الخلق والبشر وبعد: تناولت هذه الدراسة جميع أقوال سيدنا عمر (رض) في كتاب الأم قسم العبادات، ودراسة هذه الأقوال دراسة تحليلية على المذهب الحنفي والشافعي. وقد قسمت هذه الدراسة الى ثلاثة فصول: تناول الفصل الأول: سيرة عمر بن الخطاب (رض) والإمام الشافعي (رحمه الله)، كما تناول الفصل الثاني: القول في حجية الصحابي. كما تناول الفصل الثالث: تحليل أقوال سيدنا عمر(رض) تحليلاً فقهياً على المذهب الحنفي والشافعي، وذلك بذكر المسألة وأصلها ثم ذكر آراء الحنفية مع أدلتهم ثم ذكر آراء الشافعية مع أدلتهم. حيث تطرقت خلال هذه الدراسة للحديث في المبحث الأول: عن المسائل الواردة في كتاب الطهارة بعد التعريف بها لغة واصطلاحاً وبيان مشروعيتها، ثم تكلمت في المبحث الثاني: عن المسائل التي وردت في كتاب الصلاة بعد التعريف بالصلاة لغة واصطلاحاً وبيان مشروعيتها، ثم تناولت في المبحث الثالث: المسائل التي وردت في كتاب الاستسقاء بعد التعريف بالاستسقاء لغة واصطلاحا وبيان مشروعيته، كما تناولت في المبحث الرابع: المسائل التي وردت في كتاب الجنائز بعد التعريف بالجنائز لغة واصطلاحاً وبيان مشروعيتها، ثم تناولت في المبحث الخامس: المسائل التي وردت في كتاب الزكاة بعد التعريف بالزكاة لغة واصطلاحاً وبيان مشروعيته، كما تناولت في المبحث السادس: المسائل الواردة في كتاب الصيام بعد التعريف بالصيام لغة واصطلاحاً وبيان مشروعيته، ثم تناولت في المبحث السابع: المسائل التي وردت في كتاب الحج بعد التعريف بالحج لغة واصطلاحاً وبيان مشروعيته.

ABSTRACT This study deals with all the sayings of Omar bin Al-Khattab (may Allah be pleased with him) in the Kitab al-Umm, the section of worship. It analyzes these sayings through an analytical study based on the Hanafi and Shafi'i schools of thought. This study is divided into three chapters: The first chapter deals with the biography of Omar bin Al-Khattab and Imam Al-Shafi’i (may God have mercy on him). Then the second chapter deals with the sayings of our master Omar in the section of worship. Lastly, the third chapter analyzes the sayings of Omar using a jurisprudential analysis based on the Hanafi and Shafi'i schools of thought. This chapter also includes the issue and its origin, and both the opinions of the Hanafi with their evidence and the opinions of the Shafi’i with their evidence. Moreover, this study highlights many different topics. The first topic is about the issues mentioned in the book of purity after introducing them in language and conventionally and indicating their legitimacy. The second topic is about the issues mentioned in the book of prayer after introducing prayer in language and convention and its legitimacy. The third topic mentions the issues in the book of rain-invoking prayer after introducing rain-invoking in language and idiomatically and indicating its legitimacy. The fourth topic is about the issues mentioned in the book of funerals after introducing funerals in language and conventionally and stating their legitimacy. In the sixth topic, issues in the book of fasting are mentioned after introducing fasting in language and idiomatically and stating its legitimacy. The last topic deals with the issues mentioned in the book of Hajj after introducing Hajj in language and idiomatically and indicating its legitimacy.
