Hayber Yılında Vaz’ edilen Şer’i Hükümlerle İlgili Hadislerin Tahlili

Abstract

ÖZET Araplar, eskiden bir yılı o yıl içinde gerçekleşen en önemli olay ile isimlendirilirlerdi. Hicri 7 yılının Hayber yılı olması Hayber gazvesinin bu yıl da gerçekleşmesinden dolayı ismi buradan gelmiştir. Bu çalışmada “Hayber Yılında Vaz’ edilen Şer’i Hükümlerle İlgili Hadislerin Tahlili” olarak araştırmacının bu yıl içinde gerçekleşen gazvenin içeriğine ek olarak bu hüküm ve hadisleri araştırıp toplanmasıyla ele alınmıştır. Bu yıl da varid olan hükümler ibadetler, alışveriş, nikah, sosyal ilişkiler, suç ve cezalar ve yemekler ile alakalıdır. Bu çalışmada, hicri 7. Yılda varid olan hükümler araştırılırken peygamber hayatına büyük önem verilmiştir. Araştırmacı bu konunun daha önce yazılmadığını düşünerek bu konuyu araştırmıştır. Araştırmacı, bu yıl içerisindeki şer'î hükümlere delalet eden peygamber hadislerini toplama sırasında yine bu yıl içerisinde gerçekleştiğini düşündüğü bazı şer'i hükümlerin de tarihini araştırmıştır. Ve burada bir yıldan daha uzun sürede verilen hükümlerin yine hicri 7 yıldan da geçtiği görülmektedir. Araştırmacı, bu çalışmada tümevarım yöntemine başvurmuş, yanlış anlaşılan ve yanlış yorumlanmış olan bazı hususları çürüterek doğru yönlerinden bahsetmiştir. Araştırmacı, üzerinde durulması ve dikkat edilmesi gereken ve liderden kaynaklanan birçok ders bulmuş ve şûra kavramını ve onunla amel edilmesini köklendirerek bu yanlış anlaşılan haberleri gerçekleşmeden önce gizlemeyi başarmıştır.

SUMMARY The Arabs in the past used to call the year by the most important event that occurred in that year, hence the name of the seventh year of Prophet's migration year of Khaybar, because the most important event in this year was the Battle of Khaybar. This study dealt with “Sharîia Provisions in The Year of Khyber and al-Âhadith Contained Therein; Studying of Hadith Documentation”, where the researcher investigated and collected the legal rulings that came in that year in addition to what included the invasion that took place in it, as the rulings contained in that year were related to worship, and some related to dealing with transactions, including those related to marriage, including those related to social relations, including those related to felonies, and others related to foods. This study attached great importance to the Prophet’s biography by searching for the rulings contained in the seventh year of the Hijra, a study that the researcher believes that he has not previously been authored. The researcher investigated the history of some of the legal rulings that he thought occurred in that year by collecting the hadiths of the Prophet that contain evidence of the legal rulings in that year. There are some rulings in which the ruling was received in more than a year, and they were also received in the seventh year of the Hijra, so they were mentioned. The researcher relied on the method of complete induction in this study, With the refutation of some issues that had been misunderstood and interpreted in the wrong way, while mentioning their correct face, the researcher found many lessons that must be focused on and that are due to the leader and verify it from the news by rooting the concept of "shura" and working with it and concealing the news before it happens.
