FAS KRALLIĞI: DEMOKRATİKLEŞME SÜRECİ VE ANAYASA YAPIMI

Abstract

ÖZ Fas Krallığı birçok özelliği itibariyle Kuzey Afrika’nın önemli ülkelerinden birdir. Bu yüzden gerek tarihi gelişim süreci gerekse sahip olduğu siyasi rejim itibariyle diğer bölge ülkelerinden farklı bir yere konumlandırılabilir. Bu çalışmada Fas Krallığında anayasa yapım süreci incelenmiştir. Birinci Bölümde genel olarak demokratik anayasa yapımı süreci kurumsal çerçevede ele alınmıştır. Bu bölümde modern devletlerin temelini oluşturan anayasanın hizmet ettiği amaçlar ele alınarak demokratik öğelerle ilişkilendirilmiş, anayasa yapım sürecindeki değişimlerin temel dinamikleri üzerinde durularak siyasi, ekonomik ve sosyal faktörlerin bu sürece etkisi anlatılmıştır. İkinci Bölümde Fas’ın tarihi; sömürge öncesi, sömürge ve bağımsızlık dönemi, ayrıca 1962’den 1996’ya kadar olan süreçte anayasal sistemin şekillenmesi ve gelişimi ele alınmıştır. Üçüncü Bölümde “Arap Baharı” olayının etkisiyle gerçekleşen reformlar, 2011 Fas Anayasasının yapım süreci, Anayasanın özellikleri, devlet erkelerinin yapısı ve işleyişi ele alınarak incelenmiştir.

ABSTRACT The Kingdom of Morocco is one of the important countries of North Africa in terms of many features. So, It can be positioned in a different place from other countries in the region, both in terms of its historical development process and its political regime. In this study, the constitution making process in the Kingdom of Morocco was examined. In the First Chapter, the process of making a democratic constitution is discussed in the institutional framework. In this section, the aims served by the constitution, which forms the basis of modern states, are dealt and associated with democratic elements, the main dynamics of the changes in the constitution making process are emphasized and the effects of political, economic and social factors on this process are explained. In the Second Chapter, History of Morocco; The pre-colonial, colonial and independence period, as well as the shaping and development of the constitutional system in the period from 1962 to 1996 are discussed. In the third chapter, the reforms that took place under the influence of the "Arab Spring", the making process of the 2011 Moroccan Constitution, the characteristics of the Constitution, the structure and functioning of the state powers are examined.
