Abstract

ÖZ Bu tezin başlığını Al-Khatib Al-Sherbini’nin “Mughni al-Muhtaj Adlı Eserinde İçtihat Terminolojisinin Analitik İncelenmesi” olarak seçtik (İbadet Bölümü). İmam Al-Khatib Al-Sherbini’nin yazdığı Mughni al-Muhtaj adlı kitabının ışığında başta İbadet Bölümü olmak üzere iötihat terminolojisinin analitik bir incelemesiyle ele alınmaktadır. Bu çalışma İçtihat terminolojisinin tanımlanmasına büyük ilgi duyan büyük bilim adamı ve hukukçu İmam Al-Khatib Al-Sherbini tarafından yazılan kitapta bulunan hukuksal terminolojinin analizini incelemeye yönelik olup, beni özellikle ibadet konusunda incelemeye sevk etti. Bu çalışmamda, yazarın sözlerini aktardığım ve oradaki yaklaşımını gösterdiğim tümevarımsal ve analitik yönteme dayandım. Bunun yanı sıra, benimsediği ve ifadelerinde açıkça durduğu kaynakları tespit ettim. Çalışmanın doğası gereği, başlığın kelime dağarcığını tanıtmak için bu çalışmayı bir giriş bölümüne ve saflık, dua, zekat, oruç ve Hac ritüel eylemleri ile ilgili terminolojiyi incelemek için iki ana bölüme ayırdım. Bu araştırma ile bir dizi sonuç elde edildi: - İçtihat terminolojisinin anlamları tanımlanmamış gibi hukuki terminolojiyi incelemenin önemi. Bu durum yenilenme ve zamana ayak uydurma iddialarıyla din kavramının çarpıtılmasına ve onun amaç ve çıkarlarına göre manipüle edilmesine yol açacaktır.

- Al-Sherbini, açıkladığı Al-Minhaj kitabında terminolojinin ilk tanımına değiniyor. İçinde bahsedilmeyen terminolojiyi biliyor olabilir. Ayrıca dilbilimsel anlamdan ve ilgili terminolojiden de bahseder. - Al-Sherbini'nin terminolojiyi açıklamak için en popüler kaynağı al-Nawawi'nin Al-Majmoo kitabı ve onun şeyhi şeyh Zakariya Al-Ansari’nin kitaplarıdır. En ünlü dil kaynakları şunları ise al-Farahidi'nin al-Ain adlı eseri, İbn Faris'in al-Moqayis al-Lugha adlı eseri ve İbn Manzur'un Lisan el-Arab adlı eserleri olup, cümleleri genellikle bu yazarların sözlerine yakındır.

Sonuç kısmı yazılırken aşağıda belirtilmiş olan öneri ve tavsiyelerde bulunuldu: Bu mübarek projeyi tamamlamak ve bu yönde çalışmak için bu kitapta yer alan işlem ve suçlarla ilgili terminoloji çalışmasının tamamlanması gerekmektedir.

Abstract We chose the title of this thesis as “An Analytical Study of Jurisprudence Terminology in Mughni al-Muhtaj” by al-Khatib al-Sherbini (Department of Worship), “where it is concerned with an analytical study of jurisprudential Terminology in light of the book of Mughni al-Muhtaj” by Imam al-Khatib al-Sherbini in the Department of Worship in particular. It leads to study the analysis of the jurisprudential terminology found in the book, which was written by the great scholar and jurist, Imam al-Khatib al-Sherbini, who had a prominent interest in defining jurisprudential Terminology, which prompted me to study them, especially with regard to worship In the study of this topic, I relied on the inductive and analytical method, where I cited the author’s words and showed his approach therein, as well as identified the sources that he adopted, and stood at his expressions clearly. The nature of the research necessitated subdividing it into an introductory chapter to introduce the vocabulary of the title, and two main chapters to study the terminology related to the section of ritual acts of purity, prayer, zakat, fasting, and Hajj. The study Found these sum of results, which are: - The status of studying the jurisprudential terminology, as if the meanings of the terminology were not defined, it would lead to distorting the concept of religion and its manipulation, according to whims and interests, with claims of renewal and keeping up with the times. - Al-Sherbiny mentions the first definition of terminology in the book Al-Minhaj which he explained, and he may know terminology that were not mentioned in it, and he also mentions the linguistic meaning and the related terminology. - Al-Sherbini's most popular source for explaining the terminology is Al-Majmoo book by al-Nawawi, and his sheikh Zakariya al-Ansari books, and his most famous linguistic sources were: al-Ain by al-Farahidi, al-Moqayis al-Lugha by Ibn Faris, and Lisan al-Arab by Ibn Manzur, and his phrases are often close to their phrases. After writing the results in the conclusion, some recommendations and suggestions were made, which are: In order to complete this blessed project and studying in this aspect, the study of terminology related to transactions and crimes in this book has to be completed.
