İMAM MUHÂMILÎ’NIN İMAM NEVEVÎ’YE AIT KITABU’L-MECMU` ADLI ESERINDE YER ALAN TAHARET VE NAMAZ BÖLÜMLERI HAKKINDAKI GÖRÜŞLERI

Abstract

Özet “İmam Muhâmilî’nin İmam Nevevî’ye Ait Kitabu’l-mecmu` Adlı Eserinde Yer Alan Taharet ve Namaz Bölümleri Hakkındaki Görüşleri” başlıklı tezim karşılaştırmalı bir fıkhî araştırmadır. Bu tezin önemi İmam Muhâmilî’nin fıkhî hükümlerle ilgili görüşlerini toplaması, onun bu hükümler için dayandığı delilleri ve ilim ehlinin delilleriyle ortaya koyduğu kanaatlerini ve bu deliller üzerine yapılan tartışmaları zikretmesinde yatmaktadır. Araştırmacı her konudaki görüşleri en güçlü delillere dayanarak değerlendirmiştir. Bu tez bir mukaddime ve üç bölümden oluşmuştur. Birinci bölümde İmam Muhâmilî’nin ve İmam Nevevî’nin (Allah onlara rahmet eylesin) kapsamlı biyografileri ve Kitâbu’l-mecmu`adlı eserin tanıtımı yer almaktadır. İkinci bölümde İmam Muhâmilî’nin sular ve abdest konularıyla su kapları ve bunlarla ilgili hususlardaki görüşleri bulunmaktadır. Üçüncü bölümde ise namazın ezan ve imamete dair konuları işlenmiştir. Kıraatin cehrî yapılması, tahiyyatü’l-mescidin tekrar edilmesi, cuma namazı ve namaza dair konulardan namazların birleştirilmesi bu bölümde ele alınmıştır. Bu tez birçok sonuca ulaşmıştır. En önemlilerinden biri alimlerle oturması, onlardan ders alması ve fıkıh ezberiyle tanınan İmam Muhâmilî’nin ilmî konumudur. İmam Muhâmilî kitap, sünnet, icmâ` ve muteber kıyas ilmi üzerine inşa edilmiş olan tartışmalı birçok fıkhî konuda fetva vermiştir. Önemi nedeniyle İmam Nevevî’nin ansiklopedik eseri el-mecmû`adlı eserinde ondan bahsettiğini görüyoruz. Araştırmacı bu konuyu çalışırken tarihsel metot ile analiz ve karşılaştırmaya dayalı tümevarımsal metodu kullanmıştır. Çünkü bu metotlar bilimsel materyallerin toplanmasında, incelenmesinde ve bunlardan gerekli görüşlerin çıkarılmasında temel bir role sahiptir.

summary My thesis entitled (views of Imam Al-Hamili (t415 Ah) In the sections of purity and prayer from Al- Majmou’ book of Imam al-Nawawi (may Allah have mercy on him), was a (comparative jurisprudence study). The importance of this thesis lies in collecting the opinions of Imam Al-Hamili in jurisprudence issues, mentioning the evidence which they were based on, mentioning the statements of the scholars in the matter and mentioning their evidence, including the researcher’s discussion and highlighting the statements of each issue based on the strongest evidence. This thesis consisted of an introduction and three chapters, the first chapter included a thorough translation of Imam Al-Hamili (may Allah have mercy on him), Imam al-Nawawi (may Allah have mercy on him), and an introduction about Al- Majmou’ book, the second chapter discussed the views of Imam Al-Hamili on the issues of water and ablution, The third chapter discussed the issues related to prayer about the azan and the Imamate, the revelation of insurance, the repetition of the greeting of the mosque’s prayer, Al- Jomaa’ prayer, and the collection of prayer issues. The thesis conducted many results, the most important of which are: Imam al-Hamili’s scientific status, where he was known for accompanying scholars, taking knowledge from them, and preserving jurisprudence. As the Imam al-Nawawi mentioned it in his encyclopedic book Al- Majmou’. While dealing with this topic, the researcher relied on the historical approach, and the deductive approach based on analysis and comparison, because these approaches play a key role in collecting the scientific material, scrutinizing it and drawing the required opinions from it.
