803 Numaralı Bartın Şer’iyye Sicilinin Transkripsiyonu ve Değerlendirilmesi

Abstract

ÖZ Bu çalışmayla Osmanlı Dönemi Bartın bölgesinin yerel tarihine katkı sağlamak ve Bartın’ın sosyo-ekonomik ve kültürel yapısına katkıda bulunmak amaçlanmıştır. Sicil içerisinde Bartın bölgesinin sosyal ve ekonomik yapısı hakkında önemli bulgulara ulaşılması ileride şehir tarihiyle alakalı yapılması muhtemel çalışmalara yardımcı olacaktır. Bu çalışmada 1752 tasnif kodlu 803 Numaralı Bartın Şer’iyye Sicili incelenmiştir. 803 Numaralı Bartın Şer’iyye Sicili 211 sayfadan ve 122 kayıttan oluşmakla birlikte H.1301-1311 M.1884-1893 yıllarını kapsamaktadır. İncelediğimiz Şer’iyye Sicili içerisinde vekâlet, verâset, borç, vasi tayini, evlilik, çalışma izni, mala el koyma, alacak-verecek, boşanma, mal değiş tokuşu, hibe, kefalet, satış, evlilik hukuku, tapu kaydı, vakıf ve nafaka davaları bulunmaktadır. Ayrıca incelediğimiz sicil defteri Bartın Bidayet Mahkemesi’nde görülen davaları da ihtiva etmektedir. Bu sebeple incelediğimiz sicil defteri şeri mahkemelerle nizamiye mahkemelerinin kayıtlarının bir arada tutulduğunu gösteren önemli bir kaynak niteliğindedir. Bu çalışma toplamda iki bölümden oluşmaktadır. Çalışmanın Birinci bölümde Klasik Dönem Osmanlı Şer’i mahkemeleri, şer’i mahkemelerde görevli olan kişiler ve şer’iyye sicilindeki belge çeşitleri ve Tanzimat Fermanı’yla birlikte hukuksal yapıdaki değişiklikler sonucu ortaya çıkan Nizamiye Mahkemelerinin kuruluşu ve yapısı hakkında kısa bilgiler verilmiştir. İkinci bölümde ise 803 Numaralı Bartın Şer’iyye Sicili transkript edilmiş, lakaplar, meslekler ve yer isimleriyle ilgili tablolar hazırlanarak sicil defterinden elde edilen veriler değerlendirilmiştir.

ABSTRACT In this study, it is aimed to contribute to the local history of the Ottoman age Bartın region and to shed light on the socio-economic and cultural structure of Bartın. Obtaining important findings about the social and economic structure of the Bartın region in the registry may help possible studies on the history of the city in the future. In this study, the Bartın court record with the classification code of 1752 and number 803 was examined. Although the court record consists of 211 page and 122 provisions, it covers the years “h.1301-1311” and “m.1884-1893”. It is examined cases such as power of attorney, inheritance, debt, appointment of a guardian, marriage, work permit, confiscation of property, debt, divorce, property exchange, grant, surety, sale, marriage law, land registry, foundation and alimony in the court record. In addition, the registry book we examined includes the cases heard in the Bartın Bidayet Court. For this reason, the registry book that we examined is an important source that shows that the records of the courts record and the nizamiye courts are kept together. This study consists of two parts in total. In the first part, brief information is given about the classical Ottoman court record, the persons in charge of the court record, the types of documents brief information is given about the establishment and structure of the Nizamiye Courts, which emerged as a result of the changes in the legal structure with the Edict of Regulation. In the second part, the Bartın Court Record Numbered 803 was transcribed and the data obtained from the registry book were evaluated by preparing tables about nicknames, professions and place names.
