801 Numaralı Bartın Şer’iyye Sicilinin Transkripsiyonu ve Değerlendirilmesi

Abstract

ÖZ Bu çalışmada 801 Numaralı Bartın Şer’iyye Sicili incelenmiştir. İsmi geçen sicil defteri 218 sayfadan ve 125 kayıttan oluşmaktadır. Kayıtlar genel olarak vekil tayini, vesayet, borç, vasi tayini, boşanma, mihr, evlilik, mal’a el koyma, alacak – verecek gibi muhtelif konulardan oluşmaktadır. Bununla birlikte bu sicil defterinin en önemli özelliği Bartın Bidayet Mahkemesi’nde görülen davaları da içinde barındırmasıdır. Bu açıdan bakıldığında incelenen sicil defteri şeri mahkemelerle nizamiye mahkemelerinin kayıtlarının birarada tutulduğunu gösteren değerli kaynak niteliğindedir. Çalışmanın ilk kısmında Şer’i mahkemelerinin işleyişi ve yapısı, Tanzimat değişim süreciyle beraber ortaya çıkan Nizamiye mahkemelerinin kuruluşu ve yapısı değerlendirilmiştir. İkinci bölümde şer’iye sicil defterinin transkripsiyonu yapılmış, lakaplar, meslekler ve yer isimleri ile ilgili tablolar hazırlanarak sicil defteri üzerinden elde edilen bilgiler değerlendirilmeye çalışılmıştır.

ABSTRACT In this study, the Bartın Sharia Registry No. 801 was examined. The aforementioned registry book consists of 218 pages and 125 records. The records generally consist of various subjects such as appointment of proxy, guardianship, debt, appointment of guardian, divorce, mihr, marriage, confiscation of property, receivables and payables. However, the most important feature of this registry book is that it includes the cases heard in the Bartın Bidayet Court. From this point of view, the registry book examined is a valuable resource showing that the records of the sharia courts and the nizamiye courts are kept together. In the first part of the study, the functioning and structure of the Sharia courts, the establishment and structure of the Nizamiye courts that emerged with the Tanzimat change process were evaluated. In the second part, the transcription of the şer'iye registry book was made, the tables about nicknames, occupations and place names were prepared and the information obtained from the registry book was tried to be evaluated.
