Hanefi Fakihi Hüseyn bin Yahya Zendüvisti’nin Fıkıhtaki Yeri

Abstract

ÖZ … İtikâdî, ahlâkî ve iktisâdî problemler toplum olmanın vazgeçilmez unsurlarıdır. Âlimler her dönemde gerek devlet desteğiyle gerek kendi imkânlarıyla bu ihtiyaçları Kur’an ve Sünnet ışığında karşılamaya çalışmışlardır. Kur’an ve Sünnet’te kesin olarak delil bulamadıklarında, nasslara da muhâlif olmamak kaydıyla ictihâd yapmışlardır. Bu âlimlerden bir tanesi de H. 4. asırda yaşayan Buhâralı Hüseyin b. Yahya ez-Zendevestî’dir. Hüseyin b. Yahya ez-Zendevestî yaşadığı dönemin öncü âlimlerinden olup birden fazla eser kaleme almıştır. Ravzatü’l-‘Ulemâ’ ve Nüzhetü’l-Fudalâ’ esas itibariyle bir fetva kitabı olup günün şartları ve ihtiyaçlarına göre kaleme alınmış bir eserdir. Müellif, yaklaşık yüz bâbtan oluşan eserin her bâbında Hanefî imamlarının görüşlerini âyet ve hadislerle delillendirerek İmam Şâfiî’nin (r.h.) görüşleri ile mukayese eder. Müellif, konunun devamında sadece fetva ile kalmayıp âyetler, hadisler, bazı müfessirlerin yorumları, bazı âlimlerin görüşlerinden faydalanmış yer yer kıssalarla da pekiştirme yapmıştır. Tezde, Zendevestî’nin, Ravzatü’l-‘Ulemâ’ ve Nüzhetü’l-Fudalâ’ eserinin önemli bir kısmını tercüme etmeye çalıştık.

ABSTRACT Theological, moral and economic problems are also indispensable needs of being a society. Scholars have tried to meet these needs in the light of the Qur'an and Sunnah, both with the support of the state and with their own means. When they could not find any definitive proof in the Qur'an and the Sunnah, they made ijtihad without being against the verses. One of these scholars Hussain Yahia az-Zandawisati living in fourth century (hijri). Hussain Yahia az-Zandawisati was one of the leading scholars of his time and wrote more than one work. Ravzatu’l-‘Ulemâ’ and Nuzhetu’l-Fudalâ’ is essentially a fatwa book and is a work written according to the conditions and needs of the day. The author compares the views of Hanafi imams with the views of Imam Shafii (r.h.) in every chapter of the work, which consists of approximately one hundred chapters, by proving it with verses and hadiths. In the continuation of the subject, he not only made use of the fatwa, but also benefited from the verses, hadiths, comments of some commentators and the views of some scholars, and reinforced it with anecdotes from time to time. In the thesis, it is aimed to analyze a part of the works of ez-Zandawisati in Ravzatu’l-‘Ulemâ’ and Nuzhetu’l-Fudalâ’.
