İslam Aile Hukukunda Şiddetli Geçimsizlik ve Aile Arabuluculuğu

Abstract

ÖZ Bu araştırma İslam aile hukukunda aile arabuluculuğu uygulamalarının günümüz aile problemlerine ne gibi çözümler üretebileceğini ortay koymak amacıyla hazırlanmıştır. Araştırmada Kur’an ve Sünnet’te yer alan arabuculuk konusundaki hüküm ve uygulamaları içeren âyet ve hadislere yer verilmiş, Müslüman toplumlarda arabuluculuğun işleyiş süreci ve uygulanışı ele alınarak günümüz şartlarında uygulanabilirliği tartışılmıştır Araştırmada, eşler arasında şiddetli geçimsizlik, hakem, tahkim ve sulh gibi arabuluculuk konusunu ilgilendiren kavramlar incelendikten sonra İslam aile hukukundaki aile hakemliği uygulaması, hakemlerin seçilme usulü, hakemlerin görev ve yetkileri, hakem olabilme şartları, hakemliğin sona ermesi, adli yargı ve tahkim arasındaki farklar, Hukûk-ı Aile Kararnâmesi’ndeki arabuluculuğa ait düzenlemeler, bazı İslam ülkelerindeki aile hakemliği uygulamaları ve günümüzde özellikle başta Avrupa ülkeleri olmak üzere arabuluculuk uygulamalarının neler olduğu tartışılmıştır. Ayrıca aile hakemliği konusunda Batı’daki ve Türk hukuk sistemindeki uygulamalar ile İslam aile hukukundaki uygulamalar arasındaki benzer ve farklı yönler mukayese edilmiş ve Türk hukukundaki arabuluculuk uygulamalarının sorunlu noktaları tespit edildikten sonra İslam hukukundaki aile hakemliği müessesesinin günümüze intibak sorunlarının neler olduğu tartışılmıştır. Araştırma nitel ve nicel araştırma yöntemlerinin birlikte kullanıldığı karma modele sahip bir araştırmadır. Araştırmada öncelikle aile arabuluculuğu konusu nitel araştırma yöntemlerinde en sık kullanılan analiz yöntemi olan doküman analizi yöntemiyle incelenmiş ve tartışılmıştır. Daha sonra nicel araştırma yönteminde en sık kullanılan veri toplama aracı olan anket tekniği kullanılarak toplanan veriler SPSS programı ile analiz edilerek Türk toplumunda eşler arasında ortaya çıkan sorunlar ve çözüm yolları ile ilgili düşüncelerin neler olduğu empirik verilerle ortaya konulmaya çalışılmıştır. Araştırma sonucunda, İslam hukuk geleneğinde başarılı bir şekilde uygulanmış olan Aile Hakemliği uygulamasının, günümüz aile uyuşmazlıklarını çözebilecek nitelikte olduğu tespiti yapılmıştır. Ayrıca, özellikle Batı toplumlarında aile uyuşmazlıklarının çözümü noktasında benzer uygulamaların çoktan başlamış olduğu tespiti yapılmış ve farklı ülkelerdeki uygulamalardan örnekler verilmiştir.

ABSTRACT This research has been prepared to reveal what kind of solutions the family mediation practices in Islamic family law can produce to today's family problems. In the research, verses and hadiths containing the provisions and practices on mediation in the Qur'an and Sunnah were included, the functioning and application of the mediation in Muslim societies were indicated and its applicability in today's conditions was discussed. In the research, after examining the concepts related to mediation such as severe discord between spouses, family conflict, arbitration and arbitrator, the practice of family arbitration in Islamic family law, the method of choosing the arbitrators, the duties and powers of the arbitrators, the conditions for being an arbitrator, the termination of arbitration, the differences between judicial jurisdiction and arbitration, the arrangements regarding mediation in the family law, the family arbitration practices in some Islamic countries and the mediation practices today, especially in European countries, were discussed. In addition, the similar and different aspects between the practices in the Western and Turkish legal system and the practices in Islamic family law on family arbitration were compared, and after determining the problematic points of the mediation practices in Turkish law, the adaptation problems of the family arbitration institution in Islamic law to the present day were discussed. The research is a mixed model research in which qualitative and quantitative research methods were used together. In the research, first of all, the subject of family mediation was examined and discussed with the document analysis method, which is the most frequently used analysis method in qualitative research methods. Afterwards, the data collected by using the questionnaire technique, which is the most frequently used data collection tool in quantitative research method, was analysed with the SPSS program, and it was tried to reveal the problems that arise between spouses in Turkish society and the thoughts about the solutions. As a result of the research, it has been determined that the family arbitration practices, which have been successfully applied in the Islamic legal tradition, is capable of resolving today's family disputes. In addition, it has been determined that similar practices have already started for the resolving of family disputes, especially in Western societies, and examples from different countries were given.
