Avrupa İnsan Hakları Sözleşmesi Kapsamında Geri Göndermeme İlkesi: Suriyeli Mülteciler

Abstract

ÖZ Geçmişten bugüne insanlar, yaşadıkları yerde maruz kaldıkları işkence ve zulümden kaçarak daha güvenli bir ortama göç etmek zorunda kalmıştır. Tunus’ta başlayıp çok kısa bir süre içerisinde Arap ülkelerine yayılan ve “Arap Baharı” olarak adlandırılan protestolar Suriye’yi de etkisi altına almıştır. İnsan hakları ihlalleri, düşünce özgürlüğü, rejimin uyguladığı otoriter baskılar, ekonomik kriz gibi iç ve dış pek çok sebeple protestolar gün geçtikçe büyümüş ve adeta bir iç savaşa dönüşmüştür. Suriye’de yaşanan kriz, insanları güvenli ve yakın ülkelere göç etmeye zorlamıştır. Bu ülkelerden biri de Türkiye’dir. Yaşanan iç savaş nedeniyle 2011 yılı itibariyle Suriyeli mülteciler Türkiye’ye göç etmiş ve bugün sayıları 4 milyona yaklaşmıştır. Göç dalgasının kitleler halinde yaşanması ve Suriyeli mültecilerin ülkede kalma sürelerinin uzaması hem sosyolojik hem de hukuksal sorunlara yol açmıştır. Suriye’de yaşanan iç savaş nedeniyle Türkiye’ye göç eden Suriyeli vatandaşların hukuki statüsü nedir? Mültecilik kapsamında değerlendirilmeleri söz konusu edilebilir mi? Yoğun göçün ardından yaşanan sorunlar neticesinde geri gönderilmeleri mümkün müdür? Uluslararası Mülteci Hukuku ve Avrupa İnsan Hakları Sözleşmesi kapsamında değerlendirildiğinde izlenilecek yol nedir? gibi sorular çalışmamızın amacını oluşturmaktadır. Çalışmanın hazırlanması sürecinde, konu ile ilgili bilimsel makaleler, kitaplar, uluslararası sözleşmeler, yasal düzenlemeler ve internet kaynakları kullanılmış, konuyla ilgili verilen Anayasa Mahkemesi ve Avrupa İnsan Hakları Mahkemesi kararları incelenmiştir.

ABSTRACT From the past to the present, people have had to migrate to a safer environment by escaping the torture and persecution they have been subjected to in the place where they live. The protests, which started in Tunisia and spread to Arab countries in a very short time and were called the "Arab Spring", also affected Syria. It has grown day by day and almost turned into a civil war due to many internal and external reasons such as human rights violations, freedom of thought, authoritarian pressures applied by the regime, and economic crisis. The crisis in Syria has caused people to go to the nearest safer countries. One of these countries is Turkey. Due to the civil war, Syrian refugees migrated to Turkey as of 2011 and their number has reached 4 million today. Experiencing the migration wave in masses and the prolongation of the stay of Syrian refugees in the country have led to both sociological and legal problems. What is the legal status of Syrian citizens? Can they be evaluated within the scope of refugees? Is it possible for them to be sent back as a result of the negativities experienced after the intense migration? What is the way to be followed when evaluated within the scope of International Refugee Law and European Convention on Human Rights? Questions such as these constitute the aim of our study. While preparing the study in this direction; It is aimed to examine the “principle of non-refoulement” within the framework of the rules of International Law, to fill the gap in this field in terms of law and international relations and to create a resource for the studies to be done on this subject. During the preparation of the study, scientific articles, books and internet resources related to the subject were used. At the same time, international conventions, documents and regulations are included within the scope of the study.
