Sağlık Hakkı Perspektifinden Kadının Damgalanmasının Etik ve Hukuki Boyutu

Abstract

ÖZ Ataerkillik çerçevesinde aile, topluluk ve devlet üzerinde işleyen toplumsal değerler ve normların, kadın hakları bağlamında da etkili olduğu görülmüştür. Kadınların doğurganlığının onları çeşitli ayrımcılığa maruz bıraktığı görülmekle birlikte anneliğin aile ve toplumun gelişimi açısından önemli olduğu bilinmektedir. Kadınların sağlık hizmetlerine erişimde yaşadıkları sorunlar, ayrımcılık nedeniyle yetersiz beslenmeleri sonucu meydana gelen anne-bebek ölümleri, evli kadınların istenmeyen gebeliği sonlandırma talebinde eşinin onayının alınması zorunluluğu gibi cinsiyet ayrımcılığına yol açan hukuki düzenlemelerin olduğu görülmektedir. Kadınlarla ilgili tüm bu sorunların çözümü için yapılan yasal düzenlemelere kadınların da dahil edilmesinin önemli olduğu görülmüştür. Zira kadın-erkek eşitliğinin sağlanması için toplumda yerleşmiş kadın ve erkek rollerine ait ayrımcılık gösteren uygulamaların sona erdirilmesi gerekmektedir. Çalışma üç bölümden oluşmaktadır. Birinci bölümde etik kavramı, etik kavramının tarihsel gelişimi ve etik kuramlar üzerinde durulmuştur. İkinci bölümde sağlık hakkı, kadın ve sağlık hakkı, cinsel sağlık ve üreme sağlığının insan yaşamındaki önemi, uluslararası belgelerde kadının sağlık hakkı ve kadın-erkek eşitsizliğinin önlenmesine yönelik yapılan çalışmalar üzerinde incelemeler yapılmıştır. Üçüncü bölümde ise damgalama, damgalama türleri, damgalamanın aşamaları, damgalamanın nedenleri, kadının damgalanması ve damgalamanın kadın sağlığı üzerine olumsuz etkileri araştırılmıştır. Toplumlarda ataerkil anlayışın devam etmesi, hukuk kurallarının, din kurallarının ve geleneksel uygulamaların kadın haklarının sağlanması, korunması ve geliştirilmesi üzerine olumsuz etkilerinin olduğu görülmüştür. Kadınların güçlendirilmesi, kadın sağlığının korunması ve geliştirilmesi için sağlık hizmetlerine yönelik yasal düzenlemelerde devletlerin uluslararası standartların sağlanması hususunda evrensel insan hakları hukukunun ilkelerini ve işleyişini takip etmesi büyük önem taşımaktadır.

ABSTRACT Within the framework of patriarchy, it has been seen those social values and norms operating on the family, community and state are also effective in the context of women’s rights. Although it is seen that women’s fertility exposes them to various discriminations, it is known that motherhood is important for the development of the family and society. It is seen that there are legal regulations that lead to gender discrimination such as the problems that women experience in accessing health services, maternal and infant deaths due to inadequate nutrition due to discrimination, and the requirement to obtain the consent of their spouses in the request of married women to terminate an unwanted pregnancy. It has been seen that it is important to include women in the legal arrangements made to solve all these problems related to women. Because, to ensure equality between men and women, it is necessary to end the discriminatory practices of the roles of women and men established in society. The study consists of three parts. In the first part, the concept of ethics, the historical development of the concept of ethics and ethical theories are emphasized. In the second part, the right to health, the right to women and health, the importance of sexual and reproductive health in human life, women’s right to health in international documents and the studies carried out to prevent inequality between men and women were examined. In the third part, stamping, types of stamping, stages of stamping, causes of stigma, stigma of women and the negative effects of stigma on women’s health were investigated. It has been observed that the continuation of patriarchal understanding in societies and the rules of law, religious rules and traditional practices have negative effects on the provision, protection, and development of women’s rights. In the legal arrangements for health services for the empowerment of women and the protection and development of women’s health, it is of great importance for states to follow the principles and functioning of universal human rights law to ensure international standards.
