Yerel Yönetimler Ombudsmanlığı ve Türkiye Üzerine Değerlendirme

Abstract

ÖZ Demokrasi normlarına göre idare edilen ülkelerin tümünde olduğu gibi Türkiye’de de yerel yönetimlerin yeri ve önemi oldukça büyüktür. Vatandaşlara iyi hizmet sunulabilmesi noktasında yerel yönetimlerin rolü mühimdir. Yerel yönetimlerin nasıl iyileştirilebileceği, vatandaşın talep ve beklentilerine en iyi sonucun ne şekilde alınabileceği soruları, yerel yönetimler alanında yenilikler yapılmasına sebep olmuştur. Yerel yönetimlerin bu denli önemli olması zaman içerisinde bu alanda yapılan çalışmaların da sayısını arttırmıştır. Yerel yönetimlere verilen önemin artmasıyla birlikte bu birimlerin sorumlulukları da artmış, çalışma alanları genişlemiştir. Sorumluluk alanı artan yerel yönetimlerin işleyişinde zaman içerisinde birtakım aksaklıklar meydana gelmeye başlamıştır. Yaşanan aksaklıklara çözüm olarak denetim metotları geliştirilmeye başlanmış ve denetimler sayesinde yönetimlerin daha sağlıklı bir biçimde faaliyet göstermesi hedeflenmiştir. Ortaya çıkan bu denetim metotlarından biri de ombudsman denetimi olmuştur. Ombudsman denetiminin resmi olarak ilk defa 1808 yılında İsveç’te ortaya çıktığı kabul edilmektedir. Kurulduğu ilk yıllarda ilgi görmeyen kurum, kuruluşundan yıllar sonra, önceleri Avrupa ülkelerinde, ardından dünya genelinde yayılmaya ve uygulanmaya başlanmıştır. Türk idare sisteminden esinlenilerek oluşturulduğu zannedilen kurumun, Türkiye’nin denetim sistemine dahil edilmesi epey geç olmuştur. Ombudsmanlık kurumu Türkiye’de Kamu Denetçiliği Kurumu ismi ile faaliyet göstermektedir. Kurumun temel gayesi idarenin olumsuz işlemlerine karşı vatandaşın haklarını korumak ve iyi yönetim elde edilmesini sağlamaktır. Kurum Türkiye’de ulusal olarak faaliyet göstermektedir. Yerel yönetimlerde ortaya çıkan sorunlara da yine ulusal ombudsman olan Kamu Denetçiliği Kurumu çözüm aramaktadır. Ulusal ombudsmanın aynı zamanda yerel yönetimlerde meydana gelen sorunlar için de görevlendirilmiş olması birtakım aksaklıklara yol açmış ve bunun sonucunda yerel yönetim ombudsmanlığının gerekliliği çalışmalara konu olmaya başlamıştır.

ABSTRACT As in all the countries governed by the norms of democracy, the place and importance of local governments in Turkey is quite large. The role of local governments is very important in terms of providing good service to citizens. The questions of how local governments can be improved, how to get the best results for the demands and expectations of the citizens have led to innovations in the field of local governments. The importance of local governments has increased the number of studies in this field over time. With the increasing importance given to local governments, the responsibilities of these units have also increased, and their working areas have expanded. In the course of time, some disruptions have begun to occur in the functioning of local governments, whose area of responsibility has increased. As a solution to the problems experienced, auditing methods have started to be developed and it is aimed that the managements operate in a healthier way thanks to the audits. One of these emerging audit methods has been the ombudsman audit. It is accepted that the Ombudsman's supervision officially appeared for the first time in Sweden in 1808. The institution, which did not attract attention in the first years of its establishment, began to spread and be implemented years after its establishment, first in European countries and then throughout the world. The inclusion of the institution, which is thought to have been inspired by the Turkish administrative system, into Turkey's auditing system has been quite late. The Ombudsman institution operates in Turkey under the name of the Kamu Denetçiliği Kurumu. The main purpose of the institution is to protect the rights of the citizens against the negative actions of the administration and to ensure good governance. The institution operates nationally in Turkey. The Ombudsman Institution, which is also the national ombudsman, seeks solutions to the problems that arise in local governments. The fact that the national ombudsman was also tasked with the problems occurring in local governments caused some problems and as a result, the necessity of the local government ombudsman started to be the subject of studies.
