106 Numaralı Tokat Şer‘iyye Sicilinin Transkripsiyonu ve Değerlendirmesi

Abstract

ÖZ Bu yüksek lisans tez çalışmasında 1905-1909 (H.1323-1327) tarihleri arasında kaleme alınmış “106 Numaralı Tokat Şer‘iye Sicil Defteri” nin transkripsiyonu yapılarak, defterdeki hükümler aracılığıyla o dönemdeki Tokat’ın hukuki ve sosyo-ekonomik yapısı üzerinde durulmuştur. Bu çalışma içindekiler ve giriş kısmının ardından üç bölüme ayrılmıştır. İlk bölümde Osmanlı’nın klasik hukuk sisteminin işleyişi, Osmanlı’daki mahkeme kavramı, mahkemedeki görevliler, şer’iye sicillerinin hukuk açısından tanımı ve kapsamı ile alakalı bilgiler verilmiştir. Bu çalışmanın ikinci bölümünde ise transkripsiyonunu yaptığımız şer’iye sicil defterinin kısa tanıtımı ve defterin kapsadığı dönemde Tokat’ın idari, sosyokültürel ve ekonomik yapısının değerlendirilmeye çalışılmıştır. Son bölümde ise 106 Numaralı Tokat Şer’iye Sicil Defteri’nin transkripsiyonu yapılarak defterdeki davaların özetleri tablo halinde sunulmuştur.

ABSTRACT This thesis aims to transcribe “106 Tokat Ser’iye Register(Şer’iye Sicili) that belongs to the years 1905-1909(Hijri 1323-1327) and to dwell on Tokats’ legal, social and economical structures by the way of the documents in the register. This work consist of three parts after the contents and introduction parts. In the first part, information about the functioning of the classical legal system of the Ottoman Empire, the concept of the court in the Ottoman Empire, the officials in the court, the definition and scope of the şer'iye registers in terms of law are given. In the second part, the brief introduction of the ser’iye register book that we have transcribed and the administrative, socio-cultural and economic structure of Tokat in the period covered by the book were tried to be evaluated. In the last section, carefully prepared summaries of the cases in our ser’iye registry book are included in the study and the transcription of Tokat Ser’iye Registry Book numbered 106 is included.
