HANEFİ MEZHEBİNDE FARAZİ FIKHIN KONTROLLERİ

Abstract

ÖZET Tezin adı “Hanefı Mezhebınde Varsayılan Fıkhın Kontrollerı”. Tezin önemi, bilim adamlarının sanal fıkhı hakkındaki görüşlerini içermesi, Kur’an-ı Kerim, sünnet, sahabeler ve tabiinlerden deliller göstermesi, bilim adamlarının gruplaşarak bu delilleri tartışması ve doğru olup olmadığını beyan etmesinde yatmaktadır. Bu fıkıh türünü araştırırken derinlemesine araştırma yapmaya, sınırlarını ve denetimlerini ortaya koymaya özen gösterdim. Bilim adamları bu fıkıh türünün caiz olup olmadığı konusunda anlaşamadı, konuyu derinleştirdi. Araştırmacı, bu anlaşmazlıktan ne çıkardığını ve bu fıkıh türünün koşullarını özetliyor. Bu tez bir giriş ve üç bölümden oluşuyor. Birinci bölümde fıkıh, sanal ve denetim kavramlarının tanımları ve bu tanımlarla alakalı tüm terimler yer almıştır. İkinci bölümde sanal fıkhın meşruiyeti, kökeni, Irak'ta ortaya çıkış ve yayılma nedenleri ele alınmış ve araştırmacı anlaşmazlıkta bir grup bilim adamının fikirlerini tercih etmiştir. Üçüncü bölümde sanal fıkhın denetimi, ayrıca fıkıh ve fakih birbiri ile alakalı olduğu için fakih’in koşulları ele alınmıştır. Tez birçok önemli sonuca ulaştı: Bilim adamlarının ve hukukçuların yaşamın gelişmelerine ve zamanın değişimlerine ayak uydurabilecekleri, modern zorluklara ve yeni teorilere cevap verebilecekleri sanal hukukun gerekli konumunun tanımı. Bu fıkıh türü ve denetiminin diğer şeriat ilimleri gibi önemsenmesi gerekir. Sanal meselelere hâkim olunması ve düzenlenmesi gerekir. Sanal fıkıhla uğraşan fakihlerin bazı özelliklere sahip olması gerekir, böylece fıkıh bilgisi olmayanlar fakihlerle tartışmaya cesaret edemezler. Aksi taktirde fakihin nefsi onu kontrol edip doğru yoldan çıkarabilir. Sanal fıkıh, şeriat kanunlarını içerir ve bu kanunları gerçekleştirmek üzerine inşa edilmiştir.

ABSTRACT The title of the thesis is "Virtual Fiqh in the Hanafi Sect”. The importance of the thesis is that it contains the opinions of scientists about virtual fiqh, shows evidence from the Holy Qur'an, Sunnah, companions and followers, groups of scientists discuss these evidence and declare whether it is true or not. While researching this type of fiqh, I have taken care to do in-depth research and reveal its limits and controls. Scientists could not agree on whether this type of fiqh is permissible, deepening the issue. The researcher outlines what he deduces from this dispute and the circumstances of this type of fiqh. This thesis consists of an introduction and three parts. In the first chapter, the definitions of the concepts of fiqh, virtual and control and all the terms related to these definitions were included. In the second part, the legitimacy of the virtual fiqh, its origin, the reasons for its emergence and spread in Iraq were discussed, and the researcher preferred the ideas of a group of scientists in the dispute. In the third chapter, the control of virtual fiqh, as well as the conditions of faqih are discussed, since fiqh and faqih are related to each other. The thesis has reached many important conclusions: The definition of the necessary position of virtual law, according to which scientists and jurists will be able to keep up with the developments of life and the changes of time, respond to modern challenges and new theories. This type of fiqh and its control should be taken into account like other Sharia sciences. Virtual issues need to be mastered and regulated. Faqihs who are engaged in virtual fiqh need to have some features so that those who do not have knowledge of fiqh do not dare to argue with faqihs. Otherwise, the soul of the faqih can control him and lead him astray. Virtual fiqh contains Sharia law and is built on realizing these laws.
