Üniter Devlet İlkesi ile Özerklik Bağlamında Nahçıvan Özerk Cumhuriyeti’nin Statüsü

Abstract

ÖZ Nahçıvan toprakları çok eski zamanlardan beri birçok devletin ilgi odağı olmuştur. Bölge, gerek stratejik yapısı gerekse de verimli toprakları nedeniyle sürekli el değiştirmek durumunda kalmıştır. Yakın geçmişe kadar Sovyetler Birliği çatısı altında, Azerbaycan SSC sınırları içinde yer alan Nahçıvan, 1991’de bağımsızlığını yeniden kazanan Azerbaycan Cumhuriyeti sınırları içinde özerk cumhuriyet olarak varlığını sürdürmektedir. Tarih boyunca Azerbaycan ülkesinin bir parçasını oluşturmasına rağmen Nahçıvan toprakları işgalci Ermenistan devletinin ilgi odağında yer almıştır. 20. yüzyılın başlarında Güney Kafkasya’da sınırlar belirlendiği sırada, Ermenistan, asılsız bir şekilde bu toprakların kendisine ait olduğunu ileri sürerek Nahçıvan’ın kendisine bağlanmasını istemiştir. Bu nedenle sürekli olarak Nahçıvan’a karşı katliamlar yapmış ve bu toprakların kendisine geçmesi için çabalamıştır. Ermenistan’ın saldırgan siyasetini durdurmak amacıyla Türkiye, Nahçıvan Özerk Cumhuriyeti’nin kurulmasında öncülük etmiş, ilerleyen tarihlerde bu statüsünün değişmemesi konusunda hassas bir politika izlemiştir. Nahçıvan Özerk Cumhuriyeti’nin Anayasası’nın temelini Azerbaycan Anayasası oluşturmaktadır. Azerbaycan Anayasası’nın 134-141. maddelerinde Nahçıvan Özerk Cumhuriyeti’nden bahsederken Nahçıvan'ın siyasi konumu açıkça özerk bir devlet olarak belirlemiştir. Nahçıvan Özerk Cumhuriyeti’nin Anayasası ve kanunları Azerbaycan Cumhuriyeti’nin kanunlarına, Anayasasına, Cumhurbaşkanı’nın ve Bakanlar Kurulu’nun kararlarına aykırı olamaz. Görüldüğü gibi Azerbaycan Cumhuriyeti üniter bir devlet olmasına rağmen bünyesinde özerk bir cumhuriyet vardır. Nahçıvan’ı diğer özerk devletlerden ayıran en önemli fark ise bağlı olduğu Azerbaycan ile herhangi bir kara bağlantısı bulunmamasıdır. Tez çalışması, Nahçıvan’ın üniter devlet içindeki özerk konumunu ele almaktadır. Çalışmada Nahçıvan tarihinden, özerkliğinin esasları, siyasi, hukuki yapısı ve Azerbaycan Cumhuriyeti’nin üniterlik ilkesinden bahsedilmiştir.

ABSTRACT Territories of Nakhchivan have been the center of attraction for many states since ancient times. Due to their strategic structure and productive soils region, had to pass into other hands constantly. Nakhchivan, which was under the reign of the Soviet Union and within the borders of the Azerbaijan USSR until recently, continues its existence as an autonomous republic within the borders of the Azerbaijan Republic, which regained its independence in 1991. Although Nakhchivan land have been a part of Azerbaijan throughout history, it has been the focus of attention of the occupying Armenian state. At the beginning of the 20th century, when the borders were determined in the South Caucasus, Armenia unjustly claimed that these lands belonged to it and wanted Nakhchivan to be annexed to it. In order to stop the invader policy of Armenia, Turkey pioneered the establishment of the Nakhchivan Autonomous Republic and followed a sensitive policy in order to would this status unchanged in the future The Constitution of the Nakhchivan Autonomous Republic is the basis of the Constitution of Azerbaijan and the Nakhchivan Autonomous Republic is mentioned between 134th and 141th articles of the Constitution of Azerbaijan. In the Constitution of Azerbaijan, the political position of Nakhchivan was clearly determined as an autonomous state. The Constitution and laws of the Nakhchivan Autonomous Republic cannot be contrary to the laws of the Azerbaijan Republic, its Constitution, the decisions of the President and the Cabinet of Ministers. As can be seen, although the Republic of Azerbaijan is a unitary state, it has an autonomous republic. The most important difference that distinguishes Nakhchivan from other autonomous states is that it does not have any land connection with Azerbaijan, to which it is officially connected. The thesis study deals with the autonomous position of Nakhchivan within the unitary state. In the study, the history of Nakhchivan, the principles of its autonomy, its political and legal structure and the unitary principle of the Republic of Azerbaijan are mentioned.
