AZARLAMA VE CEZALANDIRMA AYETLERİ ARACILIĞIYLA BİREYİ VE TOPLUMU YETİŞTİRMEDE KUR'AN'IN YAKLAŞIMI

Abstract

ÖZET Bu araştırmada birey ve toplumun eğitiminde, kişinin tazir ve cezadan uzak durması ve bunlara maruz kalmaması için, tazir ve ceza bildiren Kur’an’daki sureler ile nebevi sünnette yer alan hadisler bağlamında Kur’an-ı Kerim yöntemi ele alınmıştır. Araştırmada kısas cezasının cinayet işlemek, infial yaratmak, toplum düzenini ve ahlakını bozmak gibi suçlarla mücadelede başarılı bir yöntem olduğu söylenmiştir. Tazir ve ceza birey ve toplumun hayatını koruyan en belirgin şer’î hükümlerdir. Öyle ki bir toplum suçluları kınamaz ve cezalandırmazsa zayıflar ve parçalanır. Çünkü o toplumda kaos, huzursuzluk, suç, cinayet ve haysiyetsizlik yaygınlaşır. Cezalar insan hayatının iyileşmesinin imkanlarını içinde barındırır. Bu konuda Allah teâlâ yüce kitabında “Sizin için kısasta hayat vardır ey akıl sahipleri, umulur ki takvalı olursunuz.” (Bakara, 179) buyurmaktadır. Tazir ve cezalar birey ve toplumun güvenlik ve huzurunu sağlar. Bununla birlikte onların toplumsal, ahlaki, siyasi ve ekonomik hayatlarını da muhafaza eder. Çalışmada tazir ve ceza ayetlerinin şeriatın maksatlarıyla olan ilişkisi üzerinde de durulmuştur. Şeriatın maksatlarının ise, kişiyi dinine ve dünyasına zarar verecek olan olan her şeyden muhafaza etmek olduğu görülmüştür. Bu maksatlar: Dinin, canın, aklın, malın, namusun ve devletin korunmasıdır. Çalışmanın son bölümünde araştırmayla ilgili elde edilen sonuçlara ve araştırmacının tavsiyelerine yer verilmiştir.

ABSTRACT In this thesis, the researcher deals with the approach of the Holy Qur’an in educating the individual and society through the surahs of the Holy Qur’an and the noble hadiths of the Prophet that are concerned with reprimand and punishment; so that a person does not commit what is forbidden. The researcher mentioned in his research that the punishment of retaliation is the effective treatment in dealing with incidents. Such as murder, lawlessness, and social and moral corruption. Reprimand and punishment are among the most prominent legal rulings in which the life of the individual and society is preserved. As every nation lives without establishing borders and without reprimand or punishment, it is a weak nation with disjointed connections; Because it will live in chaos, confusion, criminality, bloodshed, and humiliation. Then the researcher mentioned that human life can be reformed through punishments, as God Almighty mentioned in His Holy Book, "And there is life for you in (the law of) retaliation, O men of understanding, that you may guard yourselves". [Al-Baqara: 179]. Punishments and reprimand bring security and peace for the individual and society, and preserve their social, moral, security, political and economic lives. Then the researcher mentioned the relationship of the verses of reprimand and punishment with the purposes of the Sharia, as the purposes of the Sharia were found to protect human from everything that harms them in their religion and their worldly life, and these purposes are: (preserving religion, soul, mind, money, honor and the state), then the researcher concluded his research with a conclusion, which includes the results and recommendations.
