Gümrük Birliklerinde Yaşanabilecek Engeller: Türkiye’nin AB Serbest Ticareti Kapsamında Yaşadığı Zorluklar

Abstract

ÖZ Türkiye ve AB arasında 1/95 Ortaklık Konseyi Kararı ile 1996 yılında yürürlüğe giren Gümrük Birliği (GB), ticareti engelleyici unsurların ortadan kaldırılması için taraflar arasında üyelik yolunda atılmış en önemli adımlardan birisidir. Türkiye, GB’nin ardından AB üyeliğinin de geleceğini ümit ederek GB anlaşmasında birçok konuda ulusal çıkarlarından ödün veren taraf olmuştur. Fakat beklenen AB üyeliğinin henüz gelmemesinden dolayı yaşadığımız en büyük problem AB’nin üçüncü ülkelerle imzaladığı Serbest Ticaret Anlaşmaları (STA)’nda Türkiye’nin ekonomik çıkarlarının yer almamasıdır. Dolayısıyla Türkiye’nin, AB üyesi olmadığı için söz konusu STAlarda kendi çıkarlarını korumak adına müdahale hakkı bulunmamaktadır. GB anlaşmasının eksikliklerinden dolayı AB’nin STA kapsamında Türkiye’yi mecbur bıraktığı mevzuatlar Türkiye’ye sürekli olarak problemler yaşatmaktadır. Araştırmanın ana amacı AB’nin imzalamış olduğu STA’ların GB’nden dolayı Türkiye’yi kapsaması ve bu durumun Türkiye’nin ekonomik çıkarlarına verdiği zararları incelemektir. Çalışmanın hazırlanması sürecinde AB’nin üçüncü ülkelerle imzaladığı STAların GB kapsamında Türkiye’ye yaşattığı zorlukların doğru bir şekilde aktarılması için çeşitli kaynak ve dokümanların analizi yapılarak desteklenmiş, çalışmanın konusu detaylı bir şekilde tartışılmıştır. Çalışma konusunun net bir şekilde anlaşılması için GB’nin Türkiye üzerindeki ekonomik etkileri sayısal veriler kullanılarak hazırlanmış, GB öncesi ve sonrası ticaret unsurlarının karşılaştırılması yapılmıştır. Elde edilen değerlendirmeler neticesinde GB’nin Türkiye’nin ekonomik çıkarlarının da dâhil edilerek adil bir şekilde revize edilmesinin gerekliliği veyahut AB’ne Türkiye’nin ivedi bir şekilde alınarak Türkiye’nin karşı karşıya kaldığı zorlukların giderilmesi ihtiyacına ulaşılmıştır.

ABSTRACT The Customs Union (CU), which entered into force in 1996 with the 1/95 Association Council Decision between Turkey and the EU, is one of the most important steps taken between the parties on the path to membership in order to eliminate the obstacles to trade. Turkey, hoping that GB will be followed by EU membership, has been the party that compromises its national interests on many issues in the GB agreement. However, due to the fact that the expected EU membership has not yet arrived, the biggest problem we are experiencing is that Turkey's economic interests are not included in the Free Trade Agreements (FTA) that the EU has signed with third countries. Therefore, since Turkey is not a member of the EU, it does not have the right to intervene in these countries to protect its interests. Due to the shortcomings of the GB agreement, the legislation that the EU obliges Turkey under the FTA constantly causes problems to Turkey. The main purpose of the research is to examine the fact that the FTA signed by the EU covers Turkey due to its CU and the damage this situation causes to Turkey's economic interests. During the preparation process of the study, various sources and documents were analyzed and supported in order to accurately convey the difficulties that the EU has signed with third countries caused to Turkey within the scope of CU, and the subject of the study was discussed in detail. In order to clearly understand the subject of the study, the economic effects of CU on Turkey were prepared using numerical data and a comparison of pre-CU and post-CU trade elements was made. As a result of the evaluations obtained, the need for a fair revision of the GB by including Turkey's economic interests, or the need to address the difficulties faced by Turkey by urgently recruiting Turkey to the EU, has been achieved.
