İslam Hukuku Açısından Mültecilere Karşı Şiddetin Nedenleri Sonuçları Ve Çözüm Önerileri.

Abstract

ÖZET Araştırmacı bu tezde, göçmenlere ve mültecilere yönelik zorbalık meselesini ele alacak ve bu sorunu İslam hukuku ve yasalarıyla nasıl çözebileceğini inceleyecektir. Ayrıca, zorbalık konusu okullarda ve öğrenciler arasında incelenen bir konu olduğu için, bu çalışma bu araştırmalarla karşılaştırmalar yapacak ve göçmenlere ve mültecilere yönelik zorbalık arasındaki farklara dikkat çekecektir. Bu amaçla, zorbalığın tanımı, unsurları, nedenleri ve sonuçları ile genel etkenleri hakkında bilgi sunulacaktır. Aynı zamanda, göçmenler ve mültecilerin tanımı ve üzerlerindeki zorbalık türleri, anketler ve medyada yer alan verilerle ele alınacaktır.

Tezin ikinci bölümünde, bu sorunun İslam hukukuyla nasıl ele alınabileceği incelenecek ve Kur'an'da şiddet olaylarının tedavi edilmesine yönelik ayetlere vurgu yapılacaktır. Ayetler, insanlar arasındaki kardeşlik ve eşitlik çağrılarını içermektedir ve bu ayetler tek başına yeterlidir. Sonrasında, İslam peygamberi Hz. Muhammed'in hadisleri gözden geçirilecek ve tüm insanlar arasında eşitlik ilkesine vurgu yapan hadisler öne çıkarılacaktır. Ayrıca, ırk, renk, boy veya kısa boyluluk gibi özellikler nedeniyle insanlara hakaret etmek, küçümsemek veya ayrımcılık yapmak yasaklanacaktır. Ayrıca, sahabe dönemindeki çabalar ve alınan kararlar da ele alınacak ve İslam hukukundaki suçlar, cezalar ve zorbalıkla ilgili düzenlemeler gözden geçirilecektir.

ABSTRACT In this thesis, the researcher discusses the issue of bullying among migrants and refugees, and how this issue is addressed through Sharia and law. While bullying is typically studied in schools and among students, the researcher makes an effort the bullying experienced by migrants and refugees.The researcher then defines the meaning of migrants and refugees using linguistic dictionaries, political, and international customs. Next, the researcher discusses the different forms of bullying experienced by migrants and refugees. This is based on a questionnaire that was administered to a sample of immigrants and refugees, The researcher identifies dozens of forms of bullying, which they will use to develop solutions through Sharia and law. In the second chapter of the thesis, the researcher addresses the problem of bullying through Sharia. They start with the Holy Qur'an, The researcher then discusses the Sunnah of the Prophet, which is no less important than the Holy Qur'an. This includes guidance on the equality of all human beings, regardless of their race, status, or appearance, The researcher also discusses ta'zir, which is a wider chapter on penalties for bullying behaviors. Next, the researcher discusses the legal definition of bullying and whether it is considered a legal offense or a disciplinary measure. The researcher then provides a review of the treatments that they have identified to reduce bullying based on the objectives of Sharia, including necessary, recommended, and optional treatments. The researcher then discusses how bullying can be addressed through laws, also proposes treatment programs that could be implemented by civil society institutions. Finally, the thesis concludes with a summary of the results and recommendations based on the research findings. The researcher emphasizes that success in addressing the problem of bullying can only be achieved with the help of God.
