Abstract

ÖZET Bu çalışmanın amacı, imam El-sarkhsi'nin gelenek ve görenek yönündeki yaklaşımını tespit etmeye çalışmak ve bize yaklaşımını gösteren çeşitli uygulamalar üzerinde durarak bunu islam mevzuatında çıkarmaya çalışmak ve bu konuların yönleri üzerinde durarak yaklaşımını islam mevzuatında açıklamaya çalışmaktı. Onları vurgulayın ve bunların genel faydasını göstermek için çeşitli farklı konuları içerir. Bunu gerçekleştirmek için araştırmacı, eğrelti otu yöntemini gelenek ve görenek içinde tanımlayarak bilimsel materyal toplamaya ve ardından bunu açıklamak ve netleştirmek için analitik yöntemi kullanmaya dayanan tanımlayıcı yönteme güvenmiştir. ABSTRACT The goal of this study was to try to discover Imam al-Sarkhasi's perspective in terms of custom, and to conclude that under Islamic law, By evaluating various applications that demonstrate his approach, as well as examining features of these concerns and attempting to explain his technique in them, and then shedding light on them and indicating the value. One of these aspects within the issues of the individual and society is the public, and this is due to our belief in the importance of creative scientific communication in the scientific field among scholars, ancient and modern, and uncovering fundamentalists' methods in reasoning with the rules of custom and custom, and so on, and the various and multiple issues they include. To accomplish this, the researcher used the descriptive approach, which relies on collecting scientific material by following al-Sarkhasi's approach in custom and tradition, and then using the analytical approach to explain and clarify that, as well as stating the scholars' sayings in it. This study included an introduction, three chapters covering a variety of topics, a conclusion, and technical indexes. The study reached many conclusions, perhaps the most important of which is that Imam al-Sarkhasi relied on the rule of custom and custom in explaining the evidence, supporting it, and clarifying its intended purpose on the one hand, as well as explaining its purpose and benefiting from it on the other hand. This is evident in the folds of his book Al-Mabsoot in particular. The study came to several results, the most notable of which is that Imam al-Sarkhasi relied on customary law in explaining the evidence and alternative, as well as defining what was intended from one perspective. It was sometimes approved in support of it due to the basis of the evidence for its conformity with the rule of custom and tradition, which is quite clear in the chapters of his book Al-Mabsoot in particular, as well as explaining its purpose and benefiting from it.
