Toplumsal ve Sosyo-Politik Dönüşümler Ekseninde Çin Hukukunun Gelişim Süreci

Abstract

ÖZ

Günümüzde çok kutuplu uluslararası sistemin önemli güç merkezlerinden biri Çin Halk Cumhuriyeti’dir. Devlet ve hukuk tarihi açısından, ayrıca uygarlık bakımından Çin eski geleneklere sahip bir devlet olarak bilinmektedir. Çin’in gelişim tarihinde çok sayıda hanedanlıklar var olmuştur. Bu devletler iç ve dış tehditler karşısında sürekli olarak kendini koruma refleksi altında gelişmiştir. Bu faktör Çin gelenek devletine özgün bir yapı kazandırmıştır. Bu özgünlük günümüzde de devam etmekte olup Çin’e özel bir nitelik kazandırmaktadır. 20. yüzyılda dünyada gelişen olaylar Çin’in devlet sistemini ve siyasal yapısını yakından etkilemiştir. Bu dönemde milliyetçi güçlerle komünist güçler arasında yaşanan mücadele Çin’in kaderini yakından etkilemiş ve 1949 yılında Çin Halk Cumhuriyeti’nin meydana gelmesine neden olmuştur. Yukarıda bahsi geçen özgün devlet olma niteliği sosyalist sistemde de kendisini göstermiştir. Nitekim bu ülkede Sovyetlerden farklı bir sosyalist sistem şekillenmiştir. Günümüze kadar gelişen süre zarfında Çin’de yaşanan dönüşümler, ayrıca iç siyasi mücadele ve reformlar liberal ekonomi ve sosyalist ideolojiyi bir araya getirmiştir. Bahsi geçen tarihsel gelişim süreçleri Çin’in devlet ve hukuk sistemindeki değişimlerin nasıl evirildiği konusunu tartışmaya açmaktadır. Bu doğrultuda tez çalışması üç bölüm olarak yazılmıştır. Birinci bölüm teorik çerçeveyi içermektedir. İkinci bölümde Çin hukukunun tarihsel gelişimi gelenekselden moderniteye doğru ele alınmıştır. Üçüncü bölümde Çin Halk Cumhuriyeti’nin hukuk sisteminin siyasi ve toplumsal faktörlerin etkisi altında nasıl şekillendiğinden bahsedilmektedir.

ABSTRACT

In contemporary world affairs, People's Republic of China emerged as one of the most important power centers that represents the multipolar international system. It is known fact that Chinese civilization is regarded as oldest civilization of the world. Chinese people are still very much attached with their ancient customs and tradations that can be seen in their legal history as well. China has experienced severa dynasties in her history, but these dynasties constantly remained under the fear either from inside enemy or outside enemy. Therefore, these dynasties had been more focused on self-preservation against internal and external threats. Due to these reasons Chinese traditional state has been unique as far her structure is concerned. There is no much change in the situation, China is still living under old fear that gives modern Chinese state a special character. The events that took place in the world during the 20th century that also affected the China's state system and her political structure. Especially the struggle between nationalist and communist forces during this period leaved deep impact on the fate of China that consequently led to the formation of the People's Republic of China in 1949. The unique character of state that has been mentioned above also manifested itself in the Chinese brand of socialist system. Therefore it was observed that socialist system in China evolved differently from the Soviets one. The transformations that took place in China since beginning till now including internal political struggle and subsequent reforms have combined liberal economy and socialist ideology together. the process of developments that took place in China at massive level also raises the question how Chinese state and legal system evolved to cope with these changes. Accordingly, the thesis has been written in three parts. The first part deals with theoretical framework. Second part discusses about historical development of Chinese law from tradition to modernity. In the third chapter, author argued how political and social factors played major role in shaping the legal system of the People's Republic of China.
