İcra Takip İşlemlerinde Ulusal Yargı Ağı Bilişim Sistemi (UYAP) Kullanımı: İstanbul Anadolu Adliyesi İcra Daireleri Çalışanları Üzerine Bir Araştırma

Abstract

ÖZ E-devlet; kamu yönetiminin geliştirilmesi amacıyla, bilişim teknolojilerinden faydalanmak suretiyle, devletin vatandaşlarına, tüzel kişilere, kurum ve kuruluşlara karşı hizmet ve yükümlülüklerini, aynı şekilde vatandaşların, tüzel kişilerin, kurum ve kuruluşların devlete karşı görev ve yükümlülüklerini ağ üzerinde elektronik bir ortamda yerine getirdiği sistemdir. E-devletin e-adalet rolünü Ulusal Yargı Ağı Projesi (UYAP) üstlenmiştir. UYAP, bilgi teknolojilerinden yararlanarak yargının işlevselliğini ve etkinliğini arttırmak, bürokrasiyi azaltmak, mali açıdan, kâğıttan ve zamandan tasarruf etmek, standardizasyonu sağlamak, yargıyı hızlandırarak mağduriyetleri önlemek amacıyla kurulan bir bilişim sistemidir. Bu çalışma dört bölümden oluşmuştur. Araştırma için anket araştırma yöntemi uygulanmıştır. İstanbul Anadolu Adliyesi İcra Dairelerinde farklı ünvanlarda çalışmakta olan 641 personelin tamamına anket formu fiziki olarak dağıtılmıştır. Bu çalışanlardan 432’si ankete katılım sağlamıştır. Anket araştırma yöntemi ile elde edilen bilgiler ışığında İstanbul Anadolu Adliyesi icra dairelerinde farklı ünvanlarda çalışmakta olan personellerin UYAP’a ilişkin algıları tespit edilmiştir. Aynı şekilde katılım sağlayan personelin bakış açısıyla UYAP’ın eksik ve güçlü bulunan yönleri ortaya konulmuştur. UYAP’ın çalışanlara sağladığı kolaylıkların neler olduğunu belirlenmiştir. Yine aynı grup personelin UYAP’ı kullanırken sahada karşılaştıkları olumlu ve olumsuz noktalara vurgu yapılmıştır. Son olarak bu bilgiler ışığında UYAP’ın daha etkin duruma getirilmesi için önerilerde bulunulmuştur. Anket araştırma yöntemi ile elde edilen bilgiler sonucunda UYAP sisteminin en güçlü bulunan özellikleri; kâğıttan tasarruf sağlaması ve bilgi ve belge güvenliği olarak belirlenmiştir. Sistemsel kesinti, yavaşlama ve donma sorunlarına alt yapısal çözüm üretilmesi gerektiği ve çalışanların UYAP kullanımı konusunda eğitim alma ihtiyacı ve talepleri olduğu sonuçlarına varılmıştır.

ABSTRACT E-goverment gateway; It is a system in which the state fulfills its services and obligations towards the citizens, legal entities, agencies and institues, as well as the duties and obligations of citizens, legal entities, institutions and organizations towards the state, in an electronic environment on the network by making use of information technologies in order to improve the public administration. The National Judiciary Network Project (UYAP) has undertaken the role of the e-justice in e-government gateway. UYAP is an information system set up to increase the functionality and efficiency of the judiciary, to reduce bureaucracy, to save money, paper and time, to ensure standardization, to accelerate the judiciary and to prevent victimization by making use of information technologies. This study consists of four chapters. Questionnaire research method was used for the research. The questionnaire form was physically handed out to all 641 employees working under different titles in Istanbul Anatolian Courthouse Enforcement Offices. 432 of these employees participated in the questionnaire. In the light of the information obtained by the questionnaire research method, the perceptions of the employees working under different titles in the enforcement offices of the Istanbul Anatolian Courthouse regarding UYAP were established. Likewise, the strengths and weaknesess ofUYAP were revealed from the point of view of the participating employees. It has been established what are the conveniences that UYAP provides to the employees. Also, the positive and negative points that the same group of employees encountered in the field while using UYAP were emphasized. Lastly, in the light of this information, suggestions were made to make UYAP much more effective. As a result of the information obtained by the questionnaire research method, the most powerful features of UYAP system were detected as paper saving and information and document security. It has been concluded that infrastructural solutions should be found for the problems of systemic connection lost, slowing down and freezing, and that the employees need and demand training on the use of UYAP.
