Tesettürle İlgili Hadislerin Değerlendirilmesi

Abstract

ÖZ İnsanlık tarihinde insanî bir ihtiyaç olan giyinmek, gündelik hayatta önemli bir konuma sahiptir. Tesettür insan hayatında, dinî, hukukî, siyasî ve kültürel açıdan her devirde tartışma mevzusu olmuş, bazı zamanlarda sıcak ve soğuktan muhafaza bazen de ziynet için kullanıldığından, her devirde ve toplumların herbir kesiminde güncelliğini korumuştur. Kur’an-ı Kerim, tesettür ȃyetlerinin nȃzil olması sonucunda, cahiliyye toplumunun örf ve adetlerini tamamen kaldırarak insanları zor duruma düşürmemiş ve hiç bilmedikleri, tamamen onlara yabancı yeni örf ve adetler de getirmemiştir. Ancak, o zamanki halk arasında güzel sayılan örf ve adetler, İslamın inanç ve ibadetlerine tamamen ters ise, (kullukta Allah’a şirk olan puta tapmak veya bir iş hakkında fal bakmak, ok çekmek, putlara adak adamak veya kız çocuklarını diri diri toprağa gömmek gibi) bütünüyle kaldırmış, böyle olmayıp, İslȃma göre sadece eksik veya yanlışsa düzeltme yoluna gitmiştir. Tesettür meselesinde de aynı metod uygulanarak; böylelikle toplumda var olan tesettür uygulamasını kaldırmamış, ıslah yoluna giderek İslamın istediği yeni bir şekle koymuştur. Yine bir şahsın içinde bulunduğu toplum, makamı, mevkisi, yaşı, cinsiyeti, fikir yapısı veya inandığı din, o kimsede giyim tarzını etkileyen en önemli faktörlerdendir. Tercih edilen örtünme şekli kişinin yaşam tarzı ve dünya görüşü hususunda bilgi veren bir kimliktir. Kur’ân-ı Kerimin hitâb tarzı ve hadisler incelendiğinde, İslâm’ın asıl üzerinde durduğu konu; toplum ve aile asâyişinin yanı sıra, insanın dünyevî ve uhrevî menfaâti gereği fitneye ve şüpheye sevk etmeyecek, karşı cinsin arzusunu celbetmeyecek tarzda, usûlüne uygun olarak örtünmesi olduğu görülmektedir. Bu ise ancak sünneti bilmek ve tatbik etmekle olacağından, bu çalışmada tesettür kavramını islâmda temel kaynaklara bağlı kalarak İslâm hukuku ölçüsünde ele alınmıştır.

ABSTRACT İn Human History dressing up as a human need has a very important role. Veiling in human life has been a discussion point in terms of religious legal political and cultural in every period and time and kept up to date its popularity because sometimes it is used for protecting from cold and hot in some other times it is used for trapping. The Holy Quran never put the Ignorance Society in trouble via vanishing the customs and traditions of them and never served them new customs and new traditions that they were never aware of. But ıt removed totaly the customs were very opposite to Islamic Beliefs and Islamic prayers at the same time which were very popular such as; worshiping the idols (a Shirk to Allah) telling fortunes about something, drawan arrow, make a wow to the Idols or burrying baby girls alive and tried to correct the customs not totaly wrong. About the veiling issue It uses the same method; hereby The Quran didn’t abolish their veiling style, useda correctional way and reshaped it accordingto the Islam. Still the person’s society, his/ her position, his/her age, his/ her gender, his /her ideal structure, his/ her religion have the most important factors that affect his/ her dressing style. The preferred dressing styleis anidentiy that gives us the important imformation about a person’s life style and worldwiew. Analyzing the Holy Quran’s appeal style and Hadits, the main subject Islam emphasizes, covering your body a duly way without citing opposite sex’s attractions for the needs of human beings, theire arthly and ethereally benefits without dispatching any doubt and sedition more than public order of society and family. This can only be with knowing Tradition (Sunnet) and using it, in this work veiling issue deal with Islamic Law criterion’sadhering to basic resources.
