Özet
Dinde fıkıh, vazifelerin en belirgini ve ilimlerin en şereflisi olup, Cenab-ı Hakk'ın kullarını muvaffak kılma alametlerinden biridir. Seleften alim ve fakihlerin yapmaya çalıştığı şey bu hedefe ulaşmak olup, günümüze kadar da buna büyük önem vermişlerdir. Bunlardan biri olan İmam Şihabeddin Gürani, “Gayâtü’l-Emânî” adlı tefsirinde Kur’an’ın ahkam ile ilgili ayetlerini, kendisinden önceki alim ve fakihlerin metinlerini ve içtihatlarını kullanarak açıklamaya ve tefsir etmeye kendini adamıştır. Bu nakiller büyük bir malzeme oluşturmuş ve ibadetle ilgili fıkhî konuları tartışmak, Molla Gürani’nin seçimlerinde dayandığı kaynakları, kullandığı kelimeleri ve daha fazlasını ortaya çıkarmaya ihtiyaç duyar hale gelmiştir. Dolayısıyla ilmi bir ihtiyaç ‘Molla Gürani'nin (Ö.893h) 'Gayetü'l-Emani' Adlı Tefsirindeki Fıkhi Tercihleri Bakara Suresindeki Hac ve Umre ile İlgili Hükümler: Fıkhi ve Karşılaştırmalı Çalışma’ başlıklı çalışmayı meydana getirmemizi gerektirdi. Araştırmacı, çalışmasında üç temel yöntemden yararlanmıştır. Bunlardan tümevarım yötemi ile müellifin tefsirindeki metodunu ortaya çıkarmaya, Molla Gürani’nin Bakara Suresi'ndeki fıkhî tercihlerini belirleyerek onun tercih yöntemini görmeye çalışmış ve bunu hac ve umre ile ilgili ayetleri alt başlıklarda bir araya getirip çalışarak yapmayı hedeflemiştir. Tahlil yöntem, imamların fıkhi tercihlerini analiz etmeye ve bunları fıkhi delillerle ilişkilendirmeye dayanmaktadır. Son olarak karşılaştırma yöntemi ile de ilgili konuda tercih edilen görüşe ulaşabilmek için fıkhi deliller eşliğinde görüşler arasında bir dengeleme yapmak, Molla Gürani’nin Hanefi mezhebine uyan veya muhalefet eden görüşlerini beyan etmek ve kadim mezhebinden ne derece etkilendiğini ifade etmek hedeflenmiştir. Bunun yanında tezin doğal akışı bir mukaddime, hazırlık bölümü, iki fasil ve sonuçtan meydana gelmesini gerektirmiştir.
In religion, fiqh is the most obvious of duties and the most honorable of sciences, and it is one of the signs of Allah Almighty to make His servants successful. What scholars and faqih scholars from the predecessor tried to do is to achieve this goal, and they have attached great importance to it until today. One of them, Imam Shihabeddin Gurani, devoted himself to explaining and interpreting the verses of the Qur'an related to ahkam using the texts and jurisprudence of scholars and faqihs before him in his tafsir called “Gayatu'l-Emani”. These reports have created a great deal of material, and discussing fiqh issues related to worship has become necessary to reveal the sources on which Mullah Gurani relied in his choices, the words he used, and more. Therefore, there is a scientific need for ‘Mullah Gurani (D.893h) The Fiqh Preferences in his Commentary 'Gayetul-Emani’ required us to create a work entitled 'Provisions Related to Hajj and Umrah in Surat al-Baqara: Fiqh and Comparative Study'. The researcher used three basic methods in his study. From these, he tried to Decipher the author's method of interpretation with inductive method, to see Mullah Gurani's method of choice by determining his fiqh preferences in Surat al-Baqara, and aimed to do this by combining and studying the verses related to hajj and umrah in subheadings. The analysis method is based on analyzing the fiqh preferences of imams and associating them with fiqh evidence. Finally, in order to reach the preferred opinion on the related issue with the comparison method, it is aimed to make a balance between opinions accompanied by fiqh evidence, to declare Mullah Gurani's views that comply with or oppose the Hanafi sect, and to express to what extent he is influenced by the Decadent sect. In addition, the natural flow of the thesis required that it consist of a bible, a preparatory section, two chapters and a conclusion"
