Özet
Çok eski zamanlardan günümüze toplumsal düzeni sağlamak ve vatandaşların haklarını korumak amacıyla suç eylemi karşılığında ceza yaptırımı öngörülmüştür. Dönemin ve zihniyetin gerekliliğine göre cezanın türleri değişmiş ve çok ağır biçimlerde uygulanır hale gelmiştir. En ağır ceza biçiminde tanımlanan yaptırım ise ölüm cezası olmuştur. Özellikle eski medeniyetlerde ölüm cezasının infaz biçimi oldukça çeşitlidir. Bu dönemde insan zihninin sınırlarını zorlayan, dehşet verici biçimlerde uygulamalar gerçekleşmiştir. Zamanla gelişen teknoloji ve insan onuruna verilen değerin artmasıyla ölüm cezasının infazları daha acısız ve hızlı biçimlerde uygulanmıştır. Bu adım insan yaşamı için olumlu gibi görünse de aslında tartışılması gereken konu, ölüm cezasının varlığının suçluların ıslahı ve toplum düzeninin korunması konusunda ne kadar etkili olduğu sorusudur. Ölüm cezası varoluşundan günümüze hukukçu ve düşünürler tarafından üzerinde fikir çatışması oluşturan bir konu olmuştur. Buna istinaden hukukçu ve düşünürler genel itibariyle ölüm cezasını savunanlar ve bu cezaya karşı olanlar olarak iki kutuba ayrılmıştır. 20. yüzyılda insan hakları olgusunun önemine yapılan çağrılar ve uluslararası alanda yaşam hakkının savunuluyor olması ölüm cezasının kaldırılmasına yönelik güçlü bir adım olmuştur. Ancak yine de günümüzde ölüm cezası üzerine görüş birliği sağlanamayarak tartışmalar devam etmektedir. Ölüm cezası, güncel veri ve istatistikler doğrultusunda yer yer karşımıza çıksa da başta gelişmiş ülkeler olmak üzere birçok ülkede kaldırılmıştır.
Criminal sanction has been implemented to ensure social order and protect the rights of citizens since ancient times. Types of punishments have been changed according to requirements of the time and mind set, and they have been applied in very strict ways. The sanction regarded as the harshest one has been the death penalty. Types of execution of death penalty were various especially in ancient civilizations. In those times, executions were carried out in mind-bending and terrifying ways. Thanks to advancing technology and increase in value of human dignity, these executions of death penalty have occurred less painlessly and quickly. Even though this seems as a something good for human life, what to be actually discussed is how effective the death penalty in rehabilitation of the criminals and protecting social order is. Death penalty has been a controversial topic among legal experts and philosophers since its appearance. Hence, these legal experts and philosophers have been divided into two sides on this matter: those who are in favor of it, and those who are against. Call for importance of human rights in 20th century and defense of right to live in international areas have been a crucial step in repealing death penalty. However, there is still no consensus on it, and debates are still on. Death penalty can be detected in updated data statistics, yet it has been repealed in many countries particularly in developed ones."
